The present research concerns the analysis of the “Big Data” system recently implemented by the European Union (eu-LISA) and the damage that may result for regular and irregular migrant population. Eu-LISA is a centralized database that is governed by the principle of interoperability of the data stored in different technological sources for the management of EU external borders as well as police and judicial criminal cooperation. We advance the hypothesis that these techniques can affect the human right to leave any country, including one’s own, and return to the one of origin. This right belongs to customary International Law and have been enshrined in important conventional instruments. However, it is threatened by the implementation of a large-scale Technological Infrastructure (IT) System, which becomes a dangerous tool for controlling and interrupts migration flows of people to the EU thanks to the processing of biometric data within and outside the territory of its member states.

 

Ma recherche doctorale concerne l’analyse du système “Big Data” récemment mis en place par l’Union européenne (eu-LISA) et les dommages qui peuvent en résulter pour la population migrante régulière et irrégulière. Eu-LISA est une base de données centralisée régie par le principe d’interopérabilité des données stockées dans différentes sources technologiques pour la gestion des frontières extérieures de l’UE ainsi que pour la coopération pénale entre la police et la justice. Nous avançons l’hypothèse que ces techniques peuvent affecter le droit humain de quitter n’importe quel pays, y compris le sien, et de revenir à celui d’origine. Ce droit appartient au droit international coutumier et a été inscrit dans les instruments conventionnels les plus importants. Cependant, il est menacé par la mise en œuvre d’un Système d’Infrastructure Technologique (IT) à grande échelle, qui devient un outil dangereux pour contrôler et interrompre les flux migratoires de personnes vers l’UE grâce au traitement de données biométriques à l’intérieur et à l’extérieur du territoire de ses États membres.

 

Mi investigación doctoral se ciñe al análisis del sistema “Big Data, recientemente introducido por la Unión Europea (eu-LISA) y el perjuicio que de éste pueda derivarse sobre la población migrante regular e irregular. Eu-LISA es una base de datos centralizada gobernada por el principio de interoperabilidad de los datos almacenados en distintas fuentes tecnológicas para la gestión de las fronteras exteriores de la UE y para la cooperación policial y judicial penal. Nos planteamos si estas técnicas pueden afectar el derecho humano a abandonar cualquier país, incluido el propio, y regresar al original. Este derecho pertenece al derecho internacional consuetudinario y se ha incluido en los instrumentos de tratados más importantes. Sin embargo, se ve amenazado por la implementación de un Sistema de Infraestructura de Tecnología (IT) a gran escala, que se convierte en una herramienta peligrosa para controlar y detener la migración de personas a la UE a través del tratamiento de datos biométricos dentro y fuera del territorio de sus Estados miembros.
